GENERAL RENTAL CONDITIONS
Policotxe S.L. (hereinafter, the “Lessor”) rents to the person(s) identified in the contract as the driver(s) (hereinafter, the “Lessee”) the vehicle referred to in the contract (hereinafter, the “vehicle”), in accordance with the clauses and conditions set forth in this document:
1. VEHICLE USE
The rental of vehicles from Autos Mallorca is exclusively intended for touristic, occasional, or short-term use. It is not permitted to use the vehicle as a substitute for a private car for regular travel, nor to contract the rental as part of a regular or ongoing activity on the island of Mallorca, unless expressly and in writing authorized by the Lessor.
In case of reasonable doubt about the touristic use of the vehicle, the Lessor may request supporting documentation from the Lessee (such as flight tickets, accommodation or activity bookings), always with dates matching the rental period. Refusal to provide such documentation or discrepancies in the dates may be considered a breach of contract and result in rental cancellation without the right to a refund.
The vehicle may only be driven by the persons expressly authorized in the contract, provided they meet all of the following requirements:

Hold a valid category B driving license, with at least two (2) years of experience.

The license must be written in Spanish, English, or internationally recognized Latin alphabet.

Be between 21 and 75 years of age.
Applicable Supplements:

Drivers aged 21 to 24: €8/day

Drivers aged 70 to 75: €5/day
The following uses of the vehicle are strictly prohibited:

By unauthorized persons not listed in the contract.

For professional, logistics, commercial, delivery, ride-hailing (VTC), or similar services.
-
For driving lessons or practice.
-
Off paved roads.
-
For towing other vehicles.
-
For participating in competitions or speed tests.
-
For committing criminal acts or transporting prohibited goods.
-
As a habitual vehicle replacement for residents on the island.
Breach of any of these conditions will result in the automatic loss of all coverage, as well as the obligation to assume all damages, repair costs, third-party damages, and applicable penalties.
It is expressly forbidden to take the vehicle off the island of Mallorca without prior written authorization from the Lessor. In case of breach, a penalty of €950 will apply, in addition to recovery costs if necessary.
Smoking inside the vehicle is strictly prohibited. Penalty: €100 for professional cleaning and deodorization of the cabin.
2. RENTAL PAYMENT
Accepted payment methods: credit/debit cards and/or cash.
No deposit or security bond required.
Authorization of Additional Charges:
The Lessee must provide a credit/debit card, authorizing the rental agency to charge all costs related to the rental and optional extras.
3. INSURANCE
The vehicle is covered by comprehensive insurance with no deductible.
Exceptions:

Driving under the influence of alcohol, drugs, or other illegal substances.

Reckless or negligent driving.
-
Driving on unpaved or poorly maintained roads.
-
Refueling with the wrong type of fuel (additional charge: €350).
-
Loss, breakage, or misplacement of keys (penalty: €250).
-
Damage to the underside, roof, or interior of the vehicle.
-
Damage, loss, or theft of vehicle accessories.
-
Personal belongings left in the vehicle by the Lessee.
Lessee Liability:
In case of damages not covered by the insurance, the Lessee must cover all transport and repair costs, lost income, and legal expenses if they refuse to accept responsibility.
All coverage is subject to the submission of an accident report, police report, or formal complaint within 24 hours of the incident. Otherwise, it is presumed the Lessee acted in bad faith and will bear full responsibility.
4. RESERVATION BY CATEGORY, AVAILABILITY AND REPLACEMENT POLICY
At Autos Mallorca, reservations are made by vehicle category, not by specific model. During the booking process, you may see examples such as “Fiat Panda or similar”. This means you are selecting a vehicle within a given category — in this case, small cars — and the vehicle assigned may be a Fiat Panda or another model with equivalent features.
All vehicles within the same category share essential characteristics in terms of transmission type (manual or automatic), number of seats, boot capacity, and overall dimensions. The images and model names shown on the website are for illustrative purposes only.
Autos Mallorca reserves the right to assign a vehicle from the same or a higher category, at no additional cost to the customer, for operational, availability or maintenance reasons.
If you have a confirmed reservation, Autos Mallorca will make every effort to provide the model booked. However, in exceptional circumstances beyond our control — such as accident damage, unexpected mechanical failures or force majeure — we reserve the right to provide a different vehicle of the same or higher category, at no extra charge.
If no suitable alternative is available, the reservation may be cancelled without penalty and any prepayment will be fully refunded.
The renter is entitled to a replacement vehicle only if a duly completed accident report is provided and the fault lies with the third party.
The same model is not guaranteed; the replacement vehicle will be of the same or lower category (with the same number of seats).
If no replacement vehicle is available, the amount for the remaining rental days will be refunded.
No replacement vehicle or refund will be granted in the event of an accident where the renter is at fault or if no signed report from the third party is provided.
5. FUEL POLICY
The rented vehicle must be returned with a full tank of fuel. If not, the missing fuel will be charged at market price, plus a €10 administrative fee. Refueling with incorrect fuel will incur an additional charge of €350.
6. MILEAGE
All rentals include unlimited mileage at no additional cost.
7. VEHICLE CIRCULATION
Vehicles may not be taken outside of Mallorca without express authorization.
Penalty for breach: €950 plus recovery costs.
The rental agency reserves the right to repossess the vehicle at any time and location in case of breach of contract or violation of Spanish traffic laws. The Lessee will be liable for the associated transport costs and any resulting damage.
Roadside Assistance:
The Lessee may contact the rental agency for instructions. Outside of business hours, please contact the vehicle’s insurance company (details in the glove box). For serious emergencies, call 112.
When transporting children under 12 years old or shorter than 135 cm, the Lessee must provide and install appropriate child restraint systems. The Lessee is solely responsible for the suitability and proper use of the device.
The Lessee is responsible for all fines or charges resulting from traffic violations or other legal infractions during the rental period. A €25 administrative fee will apply for each fine received.
By law, rental information must be visibly displayed on the dashboard: vehicle model, license plate, rental period, and rental company. If this is not visible, the client assumes any resulting police fines.
8. VEHICLE PICK-UP AND RETURN
Pick-up and return locations and times are listed on the first page of the contract.
If the vehicle is not returned to the agreed location, the rental will continue until the vehicle is returned or reported lost/stolen.
If pick-up assistance is required due to the client’s negligence, a fee of €1.50/km will be charged (minimum €20).
For out-of-hours pick-up or return, a €30 supplement will apply.
An additional €30 cleaning fee will be charged if the interior requires special cleaning due to sand, stains, strong odors, organic residues, or other elements not removable by vacuum and dry cloth.
9. MODIFICATIONS AND CANCELLATIONS
Before the rental start date, the client may modify or cancel the reservation free of charge with at least 24 hours’ notice. Later cancellations will incur a charge equal to one day’s rental.
After the rental has started, early return of the vehicle will not result in any refund.
If the Lessee wishes to extend the rental, they must contact the agency in advance to check availability and prices.
If the vehicle is returned later than agreed without prior notice, €60 per hour will be charged, up to a maximum of €400 per day.
Vehicle pick-up and return must be during agency business hours. Outside these hours, a €30 fee will apply.

10. PROMOTIONAL CODES
Promotional codes issued by Autos Mallorca are personal, non-transferable, and valid only for the specific cases, groups, or campaigns for which they were issued.
Unauthorized, improper, or fraudulent use of a promotional code — including its use outside the intended group or its distribution without consent — may result in immediate reservation cancellation without prior notice and without the right to retain the discounted rate.
Autos Mallorca reserves the right to verify the correct use of any promotional code at the time of reservation and to take appropriate action to ensure compliance with its commercial terms.
11. VEHICLE GEOLOCATION
Vehicles may be equipped with GPS tracking systems for locating the vehicle in case of theft, non-return, accident, or breakdown.
Tampering with or deactivating the GPS system will be considered malicious intent.
12. APPLICABLE LAW AND JURISDICTION
These conditions are governed by Spanish law. In the event of dispute, conflict, or claim arising from the interpretation or execution of the rental agreement, both parties expressly agree to submit to the Courts and Tribunals of Palma de Mallorca, waiving any other jurisdiction that may apply.
